How we collect, use and protect your personal information.

Who we are

Dwellings Property Consultancy Ltd (trading as Dwellings) is the data controller for the personal information described in this notice. Registered in England and Wales, company number 09455478. Registered office: 77 Francis Road, Edgbaston, Birmingham, B16 8SP.

What we collect

  • Enquiries and valuations: your name, email, phone number, the property you're asking about and anything you tell us in your message.
  • Tenants: contact details, tenancy details, references and right-to-rent checks, rent payments, deposit details, and repair reports (including photos and access details).
  • Landlords and sellers: contact details, property details, bank details for rent payments, compliance certificates and anti-money-laundering identity checks.
  • Contractors: contact details, quotes, invoices and job records.
  • Website use: with your consent only, analytics cookies (Google Analytics) that tell us how the site is used. See “Cookies” below.

Why we use it, and our lawful basis

  • To answer your enquiry, arrange viewings and valuations, and provide our lettings, sales and management services: performing a contract or taking steps before one.
  • To meet our legal duties, for example deposit protection, right-to-rent checks, anti-money-laundering checks, safety compliance and keeping financial records: legal obligation.
  • To run and protect our business, for example passing repair details to a contractor, preventing fraud and spam, and keeping service records: legitimate interests.
  • Analytics cookies and any marketing emails: consent, which you can withdraw at any time.

Who we share it with

We only share what's needed: landlords and tenants of the same tenancy, contractors carrying out repairs, referencing and identity-check providers, government-approved deposit protection schemes, property portals when we advertise a home, our redress and client money protection schemes if a complaint or claim is made, and HMRC, local councils or the police where the law requires it.

We use trusted service providers to run our systems, including secure cloud hosting and database services (data stored in the UK and EU), email delivery, spam protection and error monitoring. They act on our instructions under data processing agreements. Where any provider handles data outside the UK, appropriate safeguards such as the UK International Data Transfer Agreement or adequacy decisions apply.

How long we keep it

Enquiries that don't lead to a service are kept for up to 2 years. Tenancy, property, financial and anti-money-laundering records are kept for at least 6 years after the tenancy or instruction ends, as the law requires, and then securely deleted.

Your rights

You can ask for a copy of your information, ask us to correct or delete it, restrict or object to how we use it, or ask for it to be moved to another provider. Where we rely on consent you can withdraw it at any time. We'll respond within one month.

If you're unhappy with how we've handled your information, please contact us first. You can also complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113.
